MUM OF offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service," "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Section 1 – Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Payment and Security

A) Payment Method

Payment for purchases is made by the customer's choice of:

  • Credit card: Visa, MasterCard, Carte Bleue, American Express
  • PayPal

a) Secure credit card payment:

You can pay by credit card: in this case, payment is made on our partner Stripe's website. No banking information concerning you passes through the site www.mumof.com. Payment by credit card is therefore perfectly secure. Your order will be recorded upon acceptance of payment by the banking service. You can pay online with confidence by entering the number, expiration date of your credit card, and the security code on the back of it in the spaces provided for this purpose.

Your credit card details are encrypted using SSL (Secure Socket Layer) protocol and never appear in clear text on the network. Payment is made directly to the bank. The seller never has access to these details and does not keep them on its servers. That is why they are requested again for each new transaction on our site.

b) Payment by PayPal:

www.mumof.com does not store any details relating to the customer's banking information. Payment is made according to the standards.

B) Fraud Prevention:

Payment verification:

The mumof.com website reserves the right to verify the validity of the payment, before the order is dispatched, by any means that the seller deems necessary (including requests for identification, proof of residence, etc.).

C) Non-Payment:

www.mumof.com reserves the right to refuse delivery or honor an order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is in progress. In the event of fraud or suspicion of fraud, the seller reserves the right to remove any member without notice or compensation.

Section 2 – Delivery and Timeframe

www.mumof.com delivers items worldwide.

A) Shipment:

MUM OF strives to ship orders within 3 to 8 business days, Monday through Friday. Orders placed on a Saturday, Sunday, or public holiday will be processed the next business day.

B) Types of Delivery:

Deliveries are made via La Poste (the French postal service). Prices vary depending on the weight of the package.

Delivery Damage

a) Typing Error:

In the event of a typing error, especially an incorrect or incomplete delivery address, the seller cannot be held responsible for the consequences in terms of delay or impossibility of delivery. The customer must provide a valid email address; otherwise, mumof.com cannot be held responsible for the consequences resulting from this. All costs related to the reshipment of products due to a customer's typing error will be the sole responsibility of the customer.

b) Delay:

The carrier's delivery times indicated above are to be taken into account from the departure of the package from our premises. We decline all responsibility for any extension of delivery times due to the carrier, especially in the event of strikes, bad weather, strikes, or force majeure. The same applies to internal delays specific to the carrier itself.

In the event of an extended delay in your delivery of more than 7 days beyond the maximum delivery time announced by the carrier, you will have the option to cancel your order. You will then be fully reimbursed within 30 days, provided you return the item if you have received it. Return costs are at your expense.

c) Delivery Failure:

In the event of a delivery failure attributable to the carrier (cases not covered: customer error in entering the address, availability in a pickup point following a failed delivery, exceeded storage period), MUMOF will compensate the full order amount to the customer following confirmation of the return of the order or loss by the carrier.

d) Non-Reception:

In case of non-receipt of the package despite its "delivered" status visible in the delivery tracking, the customer can contact www.mumof.com at contact@mumof.com for further information. The customer will be asked for his name, first name, address, telephone number, and email address to be kept updated, as well as the declaration on his honor of non-receipt of the package.

Section 3 – Return and Refund Policy

A) Right of Withdrawal:

In accordance with the provisions of the Consumer Code, the customer has a period of 14 days from the date of receipt of the order to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception, if necessary, of the return costs.

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) in such a way that they can be remarketed in new condition; they must be accompanied by the invoice or a copy in the case of a partial return. Damaged, soiled, or incomplete products will not be taken back.

If the right of withdrawal is exercised, MUM OF is required to reimburse the sums paid by the customer, free of charge, with the exception of return costs. Reimbursement is due within a maximum of 14 days.

B) Return Procedure:

  1. Notification:

To exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

  1. Return of the Goods:

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

  1. Refund:

We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

C) Exceptions to the Right of Withdrawal:

The right of withdrawal cannot be exercised for contracts for:

  • The supply of goods made to the consumer's specifications or clearly personalized.
  • The supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.
  • The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

Section 4 – Intellectual Property

A) Copyright:

The website www.mumof.com is the exclusive property of MUM OF. All texts, comments, works, illustrations, and images reproduced on the site www.mumof.com are reserved under copyright as well as intellectual property and for the whole world. As such and in accordance with the provisions of the Intellectual Property Code, only the use for private use subject to different or even more restrictive provisions of the Intellectual Property Code is authorized. Any total or partial reproduction of the site www.mumof.com is strictly prohibited.

B) Trademarks:

The "MUM OF" brand and all other brands, whether figurative or not and all other marks, trade names, service marks, trade names, illustrations, images, logos, registered or not, texts, or others appearing on our products, accessories, or packaging, whether they are registered or not, are and will remain the exclusive property of MUM OF.

Any total or partial reproduction, modification, or use of these trademarks, illustrations, images, and logos, for any reason and on any medium whatsoever, without our express prior agreement, is strictly prohibited. The same applies to any combination or conjunction with any other trademark, symbol, logo, and more generally any distinctive sign intended to form a composite logo. The same applies to all copyrights, designs, and models which are the property of MUM OF.

C) Content:

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our website and its content in accordance with these Terms of Service. The website and its content are provided for informational purposes only. Any unauthorized use of the website or its content will terminate the license granted by us, without prejudice to any other legal recourse.

The information and data concerning you are necessary for managing your order and our trade relations. In accordance with the Data Protection Act of January 6, 1978, you have the right to access, rectify, and oppose personal data concerning you at any time. You expressly agree that your use of, or inability to use, the service is at your sole risk. In no case shall MUM OF, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
